New small-claims service for IP claims

The government has announced that it will be introducing a small-claims track for Intellectual Property cases in the Patents County Court.

The Hargreaves Review recommended that this measure be taken, reporting that some 17% of small and medium sized enterprises had given up attempting to enforce IP rights due to high costs.

The small-claims track will limit costs to a fixed amount and allow damages of up to £5,000. It is envisaged that this service will be in place by the end of 2012.

The Intellectual Property Office estimate that around 150 firms will benefit from the service each year.
